No liability whatsoever will be accepted by the owner or any representative of Portavogie Studio for any failure of devices used to access, play, or read information on this website or on any external websites accessed through links contained herein.
2. Copyright and Ownership
While every precaution has been taken to avoid breaching the copyright of others, neither the author nor anyone associated with Portavogie Studio shall be held liable if another party claims ownership of any lyrics.
Users are responsible for conducting their own research and exercising due diligence prior to using any lyrics published on this website or on SoundCloud.
3. Use of AI and Demonstrations
Unless otherwise stated, all lyrics have been written by David Caldwell, who is the sole owner.
However, the backing tracks, melodies, tempos, and vocal performances accompanying them have been primarily generated using AI.
These are intended solely as demonstrations to illustrate how the lyrics might be interpreted or performed in a public setting.
4. Adaptations and Modifications
If you choose to adapt or modify any lyrics to suit your performance style, please inform Portavogie Studio of your intended changes and performance details via the Permission to use page.
This helps maintain accurate permission records and ensures proper future usage tracking.
5. Commercial Use and Record Deals
If you intend to use any lyrics as part of a commercial recording or negotiation (as defined by MCPS), you must notify Portavogie Studio prior to engaging in any external agreements.
6. Performance and Payments
Musicians performing in public venues are paid directly by event organisers for their performances.
The author receives payment through PRS or MCPS from the licensing fees collected by those organisations.
7. Performance Fees
Except in cases where a specific commission or contract has been agreed upon in advance, Providing he knows about it ahead of time, the author reserves the right to charge a nominal token fee for performing any of his lyrics.
8. Courtesy Copies
As a matter of courtesy, performers may be asked to provide a free copy of any recorded material that incorporates all or part of the author’s lyrics.
9. Single Tracks
Although individual tracks are free to download, they do not contain printed literature.
If you require a copy of the lyrics, they can be obtained by using our Contact page.
10. Artwork
When purchasing material from the Long Play Album list, please note that artwork will be kept minimal.
Portavogie Studio believes the focus should remain on the music and lyrics rather than visual design.
11. Album Content and Format
Wherever possible, all long play albums will be made available for download and will include a printable data sheet containing the lyrics and a general summary of each song.
12. Album Composition
Unless otherwise stated prior to sale, each album will contain 12 named tracks within the specified genre, along with one additional mystery track selected from the most popular SoundCloud listings at the time of compilation.
13. Recording Format
All albums in the “Twelve Plus One” series will be produced as a single continuous MP3 file with a brief 2.5-second pause between tracks.
Other formats can be supplied upon request.
14. Custom Album Service (Upcoming)
When available, listeners will have the option—at a small additional fee—to select 12 tracks of their choice from the SoundCloud catalogue.
The additional “plus one” track may include a recorded dedication of up to two minutes for a friend or loved one.
The track order can also be customised according to your preference.
15. Changes
Portavogie Studio reserves the right to change, append, or update these Terms and Conditions, together with the Privacy Policy, at any time in the future.
The latest version will always be available on this website.
16. Free Promotions and Third-Party Services
From time to time, Portavogie Studio may advertise or share information about special promotions or free services offered by third parties.
No one at Portavogie Studio shall be held accountable if the promoter or service provider decides to withdraw, alter, or discontinue the service or offer at any time in the future.
Portavogie Studio will not be liable for any malfunction, fault, or issue arising from the use of any such service or offer, including but not limited to damage, loss, or disablement of any device connected to or used with it.
17. Accuracy of Offers and Services
All offers, promotions, and service details published on the Portavogie Studio website are accurate at the time of publishing.
Portavogie Studio reserves the right to update, amend, or remove any offer or service information without prior notice.
18. Third-Party Upgrades and Packages
As with most free promotions, these are typically related to a starter or basic package.
The supplier may subsequently offer paid upgrades or enhanced functionality.
Portavogie Studio has no control or involvement in these upgrades and assumes no responsibility for any resulting agreements or transactions between users and third-party providers.
19. Annual Draw
Starting in 2026, our annual draw for a US$100 Amazon or PayPal voucher will be held on December 1st each year by a verified member of PRS in the UK. The winner will be announced on our website and will also be notified via the email address or phone number they provided. If the prize is not claimed within the first week, a new winner will be drawn every 7 days until contact is made. If the winner prefers to receive their winnings in a different form, as long as it can be sourced electronically, a suitable voucher of a different name will be obtained. No cash alternative is available.
